PM Tours Terms of Service

01. Terms

By accessing the website at https://www.pm-tours.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

 

02. Use License

a. Permission is granted to temporarily download one copy of the materials (information or software) on PM tours’ website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;

  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

  3. attempt to decompile or reverse engineer any software contained on PM Tours’ website;

  4. remove any copyright or other proprietary notations from the materials; or

  5. transfer the materials to another person or "mirror" the materials on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by PM Tours at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

03. Disclaimer

a. The materials on PM Tours' website are provided on an 'as is' basis. PM Tours makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

b. Further, PM Tours does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

04. Limitations

In no event shall PM Tours or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on PM Tours' website, even if PM Tours or a PM Tours authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

05. Accuracy of materials

The materials appearing on PM Tours' website could include technical, typographical, or photographic errors. PM Tours does not warrant that any of the materials on its website are accurate, complete or current. PM Tours may make changes to the materials contained on its website at any time without notice. However PM Tours does not make any commitment to update the materials.

 

06. Links

PM Tours has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by PM Tours of the site. Use of any such linked website is at the user's own risk.

07. Modifications

PM Tours may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

 

08. Governing law

These terms and conditions are governed by and construed in accordance with the laws of Thailand and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

 

09. Credit card charges

PM Tours charges fees on credit cards according to the country of operation or destination country. PM Tours is not responsible for any charges applied to credit card transactions and will not refund or return any fees charged by third parties and incurred during the transaction of the tour cost.

 

10. Cancellation of a tour by the client

Customers and booking agents must notify PM Tours of any cancellations. PM Tours will not provide discounts or refunds for missed or unused services, whether voluntary or involuntary. The following cancellation and no-show fees are expressed as a percentage of the total tour price:

  • 100% refund if cancellation is received 24 hours prior to tour departure*. (Please find exceptions below)

  • No refund if cancellation is received less than 24 hours prior to tour departure.

* For the "Elephant Nature Park" tour, we do not accept any cancellations, refunds, or changes because this is the policy of "Elephant Nature Park".

* For the ATV 70% Off-Road tour, a 100% refund if cancellation is received 48 hours prior to tour departure

* Tickets for the Loy Krathong and Yeepeng Festivals are non-refundable.

* In the case of a private tour, a 100% refund is given if cancellation is received 96 hours prior to tour departure.

In general, any transfer fee incurred by PM Tours to process the refund will be deducted from the total refund amount.

11. Cancellation of a tour by PM Tours

PM Tours reserves the right to cancel any trip for any reason, but will only cancel a tour less than 30 days before departure for unusual or unforeseen circumstances outside PM Tours’ control (Force Majeure) or if there are too few people to operate the trip. When PM Tours cancels a tour, the client may choose between a full refund of all monies paid or choose any alternative tour offered by PM Tours. If the alternative trip is less costly than the original then PM Tours will refund the difference. Similarly, if the alternative is more costly then the customer is obligated to pay the difference. PM Tours is not responsible for any incidental expenses or consequential losses that the client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, etc. Where a significant alteration or cancellation occurs which is not due to Force Majeure or other circumstances beyond PM Tours’ control, PM Tours will in some circumstances offer compensation. PM Tours will compensate on a case-by-case basis.

 

12. Changes

a. Changes made by PM Tours: PM Tours endeavours to operate all tours as advertised in the itineraries. The provided itineraries are accurate accounts of your trip. Please note, however, that PM Tours regularly updates each trip according to customer recommendations and changes on the ground. Varying conditions and unforeseen circumstances may alter the itinerary, which does not represent a contract between PM Tours and its customers. The itinerary is subject to change before and during the trip. We reserve the right to make changes without prior notice.

b. Changes made by the Client: Clients must notify PM Tours in writing if they wish to change a booking. In some circumstances we can waive the cancellation fee. Otherwise, the customer must cancel the old trip and make a new booking. The customer must be aware of the cost differences according to season and must be prepared to pay the difference if the trip is changed to a new and more expensive season. Customers can change the name on a booking or change the hotel pick up at any time.

 

13. Price validity

The prices in this document are in effect at time of printing. PM Tours reserves the right to alter prices at any time. Customers should go to www.pm-tours.com for the most recent prices and itineraries.
